Copyright and Licensing Policy
The International Journal of Legal Studies, Institutions, and Governance (IJLSIG) respects the moral and economic rights of authors. Authors retain copyright in their articles published by IJLSIG, and all content is made available under the Creative Commons Attribution 4.0 International Licence (CC BY 4.0) unless otherwise stated.
1. General Principle
The International Journal of Legal Studies, Institutions, and Governance (IJLSIG) respects the moral and economic rights of authors and promotes the lawful dissemination and reuse of scholarly works.
Authors retain copyright in articles published by IJLSIG.
Publication in IJLSIG does not transfer ownership of copyright to the journal or to PT Darma Cendekia Pustaka. Instead, authors grant the journal and publisher the rights necessary to publish, distribute, preserve, identify, and maintain the scholarly record.
Unless otherwise expressly stated, IJLSIG articles are published under the Creative Commons Attribution 4.0 International Licence (CC BY 4.0).
2. Applicable Legal Framework
Copyright and licensing of IJLSIG content are governed by:
- the laws of the Republic of Indonesia, including Law Number 28 of 2014 on Copyright;
- the Creative Commons Attribution 4.0 International Licence;
- the publication agreement accepted by the authors;
- applicable international copyright principles; and
- other mandatory laws applicable to a particular work or use.
Where this policy refers to CC BY 4.0, the authoritative terms are the official Creative Commons legal code available at: https://creativecommons.org/licenses/by/4.0/legalcode
3. Copyright Ownership
Copyright in an article remains with the author or authors, except where:
- copyright is legally owned by an employer, institution, government body, funder, or another party;
- the work was created under an agreement that validly assigns copyright to another party;
- part of the article incorporates material owned by another copyright holder; or
- applicable law provides otherwise.
Authors must identify the correct copyright holder before publication.
Where copyright is owned by an institution or another party, the authors must obtain the authority required to submit and publish the article under this policy.
4. Moral Rights
Authors retain their moral rights in accordance with applicable law. These rights include, as applicable:
- the right to be identified as the author;
- the right to use the author’s name or authorised pseudonym;
- the right to object to false attribution;
- the right to maintain the integrity of the work; and
- other moral rights recognised under applicable law.
The right to adapt material under CC BY 4.0 must not be exercised in a manner that falsely represents the authors’ views, damages the integrity of the original work, or implies endorsement by the authors, IJLSIG, or PT Darma Cendekia Pustaka.
5. Right of First Publication
By accepting publication in IJLSIG, the authors grant IJLSIG and PT Darma Cendekia Pustaka the right of first publication.
The authors authorise IJLSIG to identify itself as the original journal of publication and PT Darma Cendekia Pustaka as the publisher.
After publication, authors may enter into additional non-exclusive arrangements for distribution or reuse, provided that:
- IJLSIG is acknowledged as the original place of publication;
- the original article citation and DOI are included;
- the CC BY 4.0 licence is retained where applicable; and
- the subsequent arrangement does not misrepresent or restrict rights already granted to the public.
6. Non-Exclusive Publishing Licence
The authors grant IJLSIG and PT Darma Cendekia Pustaka a non-exclusive, worldwide, royalty-free licence to:
- publish the article in electronic, printed, and other formats;
- reproduce and distribute the article;
- communicate and make the article available to the public;
- prepare technical or accessibility formats;
- copyedit, typeset, format, and proofread the article;
- translate article metadata and abstracts where necessary;
- register and maintain the DOI;
- submit metadata and content to indexing services, libraries, repositories, and databases;
- archive and preserve the article;
- migrate the article to new platforms or formats;
- issue corrections, expressions of concern, retraction notices, or other publication-status notices;
- protect the integrity of the published record; and
- authorise service providers to perform activities necessary for publication, indexing, preservation, and distribution.
This licence does not authorise IJLSIG or PT Darma Cendekia Pustaka to materially alter the authors’ scholarly arguments or conclusions without the authors’ consent, except where editorial action is required under the Retraction and Correction Policy.
7. Creative Commons Attribution 4.0 International Licence
Unless otherwise expressly identified, IJLSIG articles are licensed under CC BY 4.0.
Under this licence, users may:
- copy and redistribute the article in any medium or format;
- share the article through websites, repositories, databases, or educational platforms;
- remix, transform, translate, or build upon the article;
- use the article for academic, educational, professional, governmental, or commercial purposes;
- include the article in collections or derivative works; and
- conduct text and data mining or other lawful computational analysis.
These rights are granted for the duration of the applicable copyright and are not revocable from a user who complies with the licence terms.
8. Attribution Requirements
A person who shares or adapts an IJLSIG article must:
- identify the author or authors;
- state the article title;
- identify IJLSIG as the journal of first publication;
- provide the volume, issue, year, and article or page number, where applicable;
- include the DOI or permanent URL;
- provide a link to the CC BY 4.0 licence;
- indicate whether the material was modified, translated, shortened, or adapted;
- retain previous modification notices, where applicable; and
- not imply endorsement by the authors, IJLSIG, or PT Darma Cendekia Pustaka.
Attribution may be provided in a manner reasonable to the medium, means, and context of the use.
Author(s). “Article Title.” International Journal of Legal Studies, Institutions and Governance, Volume [X], Number [X], [Year], DOI: [DOI]. Licensed under CC BY 4.0.
9. Copyright and Licence Notice
Each published article should display a notice substantially in the following form:
The licence logo or link should be displayed on the article landing page and, where technically possible, in the article PDF and metadata.
10. Author Self-Archiving and Redistribution
Authors may deposit and redistribute:
- the submitted manuscript or preprint;
- the accepted manuscript;
- the published Version of Record; and
- permitted supplementary materials.
Authors may use institutional repositories, subject repositories, personal academic websites, research networks, government databases, or other lawful platforms. No embargo period applies.
The deposited version should include:
- the original article citation;
- the DOI or permanent IJLSIG URL;
- acknowledgement of IJLSIG as the journal of first publication;
- acknowledgement of PT Darma Cendekia Pustaka as the publisher; and
- the CC BY 4.0 licence notice.
11. Author Warranties
By submitting a manuscript, the authors represent and warrant that:
- the manuscript is original;
- they possess the rights necessary to submit and publish it;
- the manuscript does not unlawfully infringe another person’s copyright or intellectual property rights;
- all third-party material has been appropriately identified;
- all required permissions have been obtained;
- the manuscript does not contain unlawful, defamatory, or knowingly false material;
- publication does not breach confidentiality, legal privilege, professional secrecy, privacy, contractual obligations, or applicable law;
- all authors have approved the submission and publication;
- the corresponding author is authorised to act on behalf of all authors;
- any prior publication or substantial overlap has been disclosed;
- all funding and conflicts of interest have been disclosed; and
- the use of artificial intelligence or other technological tools has been disclosed where required.
Authors remain responsible for the accuracy of these representations after publication.
12. Multiple Authors
For a jointly authored article, each author must consent to submission and publication.
The corresponding author is responsible for:
- obtaining the approval of all authors;
- confirming the author list and order;
- communicating the licensing terms to all authors;
- obtaining any institutional approval required;
- collecting relevant copyright and permission information; and
- ensuring that all authors approve the final Version of Record.
No author may grant rights exceeding the rights that the author lawfully possesses.
13. Third-Party Materials
CC BY 4.0 applies only to material for which the authors or another identified licensor possess the necessary rights.
Third-party materials may include photographs, illustrations, maps, tables/figures, survey instruments, court documents, archival records, government/institutional documents, copyrighted legal databases, software/code/data, and other protected materials.
Where third-party material is excluded from CC BY 4.0, the article must contain an appropriate credit line identifying:
- the copyright holder;
- the source;
- the applicable licence or permission; and
- any restrictions on reuse.
A user who wishes to reuse excluded material must obtain permission from the relevant copyright holder unless the use is permitted by an applicable legal exception or limitation.
14. Permissions
Authors are responsible for obtaining written permission to reproduce third-party material where permission is legally required.
Permission must cover:
- electronic publication;
- open-access distribution;
- worldwide availability;
- long-term archiving;
- the applicable Creative Commons licence, where authorised; and
- any relevant translation, adaptation, or format conversion.
Evidence of permission must be provided to the Editorial Team upon request. IJLSIG may remove or refuse material where the necessary rights cannot be verified.
15. Public-Domain and Openly Licensed Materials
Material in the public domain or available under another open licence may be included where legally permissible.
Authors must:
- identify the source;
- provide appropriate attribution;
- state the applicable licence or public-domain status;
- comply with the original licence terms; and
- avoid suggesting that a broader licence applies than the authors are legally entitled to grant.
The use of publicly accessible material does not necessarily mean that the material is in the public domain or free from copyright.
16. Research Data, Software, and Supplementary Materials
The copyright and licence applicable to research data, software, instruments, and supplementary materials must be identified separately where necessary.
CC BY 4.0 does not automatically override:
- software licences;
- database rights;
- contractual restrictions;
- confidentiality obligations;
- data protection requirements;
- informed consent restrictions;
- legal privilege;
- professional secrecy; or
- national security and public safety requirements.
Authors are encouraged to use appropriate open licences for data and software where legally and ethically possible.
17. Artificial Intelligence-Generated Material
Authors remain responsible for all material included in their manuscripts, including material created or modified using artificial intelligence tools.
Authors must ensure that:
- the material does not infringe third-party rights;
- the author possesses the authority required to publish and license it;
- the use of the tool is disclosed where required;
- generated references, quotations, data, images, or legal materials are independently verified;
- confidential or personal information has not been improperly disclosed to the tool; and
- the material complies with IJLSIG publication ethics.
Note: An artificial intelligence tool cannot be listed as an author or copyright holder. IJLSIG may reject or remove material where ownership, originality, or licensing cannot be established.
18. Journal Name, Logo, and Publisher Identity
The CC BY 4.0 licence applicable to articles does not license:
- the IJLSIG name;
- the IJLSIG logo;
- the PT Darma Cendekia Pustaka name or logo;
- trademarks, service marks, or trade dress;
- website design and journal branding; or
- material expressly identified as excluded.
The journal and publisher names may be used for accurate citation and factual identification. They must not be used in a manner that implies sponsorship, partnership, accreditation, endorsement, or official affiliation without written permission.
19. Patent, Trademark, Privacy, and Other Rights
CC BY 4.0 does not grant patent or trademark rights. The licence also does not eliminate rights relating to:
- privacy;
- personal data;
- publicity or personality;
- confidentiality;
- legal privilege;
- professional secrecy;
- ethical approval;
- informed consent;
- national security; or
- other rights held by third parties.
Users remain responsible for determining whether additional permission is required for their intended use.
20. Translations and Adaptations
Users may translate or adapt an IJLSIG article under CC BY 4.0.
A translation or adaptation must:
- identify the original authors;
- cite the original IJLSIG publication;
- include the DOI or permanent URL;
- link to CC BY 4.0;
- clearly state that the material is a translation or adaptation;
- identify the person responsible for the translation or adaptation;
- indicate material changes; and
- not imply that the authors, IJLSIG, or publisher approved the adaptation unless written approval was obtained.
A translated or adapted work must not be presented as the official IJLSIG Version of Record.
21. Corrections, Retractions, and Publication Status
Corrections, addenda, expressions of concern, and retraction notices are protected and licensed in accordance with the notice displayed on the relevant publication.
Retraction does not normally eliminate copyright or automatically revoke rights previously granted under CC BY 4.0.
A person redistributing a retracted article must not conceal its retracted status and should include the retraction notice or a clear link to it. IJLSIG may mark, correct, restrict, or remove content in accordance with its Retraction and Correction Policy.
22. Copyright Infringement Reports
A person who believes that IJLSIG has published material that infringes copyright should submit a written notice through the official contact channel listed on the IJLSIG website.
The notice should include:
- the complainant’s name and contact details;
- identification of the copyrighted work;
- identification of the allegedly infringing IJLSIG content;
- the article title, DOI, and relevant pages or passages;
- evidence of copyright ownership or authority to act;
- an explanation of the alleged infringement;
- any relevant licence or permission information; and
- a declaration that the report is submitted in good faith.
IJLSIG may temporarily restrict access where immediate action is reasonably necessary. The authors will normally be given an opportunity to respond. The journal may issue a correction, amend a credit line, remove particular material, retract the article, or take another proportionate action.
23. Licence Violations
Where a user fails to comply with CC BY 4.0, the user’s licensed rights may terminate in accordance with the licence terms. Compliance may be restored as provided under CC BY 4.0.
Nothing in this policy prevents an author or copyright holder from seeking an appropriate remedy for:
- failure to provide attribution;
- false attribution;
- infringement of excluded third-party material;
- unauthorised use of a trademark or logo;
- violation of moral rights;
- misrepresentation or false endorsement; or
- another violation of applicable law.
24. No Implied Endorsement
Reuse, citation, translation, or adaptation of an IJLSIG article does not imply that:
- the authors endorse the user;
- IJLSIG endorses the user or adapted work;
- PT Darma Cendekia Pustaka sponsors or approves the use; or
- the adapted work constitutes an official IJLSIG publication.
25. Policy and Licence Changes
A change to this policy will not retroactively restrict rights already granted under the licence attached to a published article.
The copyright and licence notice displayed on each article constitutes the authoritative licensing information for that article.
Where this policy and the official CC BY 4.0 legal code are inconsistent, the official CC BY 4.0 legal code governs the exercise of rights under that licence.
26. Relationship with Other IJLSIG Policies
This policy must be read together with:
- Open Access Policy
- Publication Ethics
- Plagiarism Policy
- Retraction and Correction Policy
- Conflict of Interest Policy
- Article Processing Charge Policy
- Archiving Policy
