Open Access Policy

The International Journal of Legal Studies, Institutions, and Governance (IJLSIG) is a fully open-access scholarly journal. All articles are made freely and permanently available online immediately upon publication without any subscription, access, or embargo fees.

1. Open Access Commitment

The International Journal of Legal Studies, Institutions, and Governance (IJLSIG) is a fully open-access scholarly journal.

All articles published by IJLSIG are made freely and permanently available online immediately upon publication. The journal does not impose an embargo period.

Readers may access the full text of every article without:

  1. paying a subscription fee;
  2. paying a download or access fee;
  3. registering an account; or
  4. obtaining prior permission from the journal merely to read the article.

IJLSIG believes that immediate and unrestricted access to legal and governance scholarship supports the dissemination of knowledge, encourages academic discussion, strengthens public institutions, and contributes to legal and institutional reform.

2. Definition of Open Access

For the purposes of this policy, open access means that published scholarly content is freely available through the public internet and may be read, downloaded, copied, distributed, printed, searched, linked, indexed, and otherwise lawfully used in accordance with the applicable licence.

Open access does not eliminate the obligation to:

  1. acknowledge the authors;
  2. cite the original publication accurately;
  3. respect the integrity and reputation of the authors’ work;
  4. identify any changes made to the material;
  5. comply with the applicable Creative Commons licence; and
  6. respect rights in third-party materials that are not covered by the article’s licence.

3. Open Access Model

IJLSIG applies a Gold Open Access publishing model.

Under this model, the final Version of Record is made openly accessible on the IJLSIG website immediately upon publication.

The open-access status of an article is not affected by:

  1. the authors’ institutional affiliation;
  2. the authors’ country of residence;
  3. whether the research received external funding;
  4. whether an Article Processing Charge applies; or
  5. the subject or conclusions of the article.

Editorial decisions are based solely on academic merit, relevance, originality, ethical compliance, and the quality of the manuscript.

4. Open-Access Licence

Unless otherwise expressly stated, articles published by IJLSIG are licensed under the:

Creative Commons Attribution 4.0 International Licence (CC BY 4.0)

The full licence terms are available at: https://creativecommons.org/licenses/by/4.0/

Under CC BY 4.0, users may:

  1. copy and redistribute the article in any medium or format;
  2. share the article through websites, repositories, databases, or educational platforms;
  3. adapt, remix, transform, translate, or build upon the article;
  4. use the article for academic, educational, professional, governmental, or commercial purposes; and
  5. conduct text and data mining or other lawful computational analysis.

These permissions apply provided that the user complies with the attribution requirements.

5. Attribution Requirements

A person who uses or redistributes an IJLSIG article must:

  1. give appropriate credit to the author or authors;
  2. state the article title;
  3. identify IJLSIG as the original journal of publication;
  4. include the volume, issue, year, page or article number, where applicable;
  5. provide the article DOI or permanent URL;
  6. provide a link to the CC BY 4.0 licence;
  7. indicate whether changes, translations, or adaptations were made; and
  8. not imply that the authors, editors, journal, or publisher endorse the user or the adapted work.
Recommended Attribution Format:
Author(s). “Article Title.” International Journal of Legal Studies, Institutions and Governance, Volume [X], Number [X], [Year], DOI: [DOI]. Licensed under CC BY 4.0.

6. Copyright

Authors retain copyright in their articles.

By submitting and publishing an article in IJLSIG, the authors grant PT Darma Cendekia Pustaka and IJLSIG the non-exclusive right to:

  1. publish the article;
  2. identify IJLSIG as the original place of publication;
  3. distribute and archive the article;
  4. register and maintain the article’s DOI and metadata;
  5. reproduce the article in formats required for accessibility, preservation, indexing, or dissemination; and
  6. take appropriate action to protect the integrity of the scholarly record.

The detailed allocation of rights and responsibilities is governed by the IJLSIG Copyright and Licensing Policy and the publication agreement accepted by the authors.

7. Author Self-Archiving

Authors may deposit and share the following versions of their manuscript:

  1. the submitted manuscript or preprint;
  2. the accepted manuscript following peer review; and
  3. the final published Version of Record.

Authors may deposit these versions in institutional repositories, subject-based repositories, personal academic websites, research networking platforms, funder-designated repositories, government databases, and other lawful non-exclusive repositories. No embargo period applies.

When depositing the final published version, authors should include:

  1. the complete bibliographic citation;
  2. a statement that the article was first published by IJLSIG;
  3. the article DOI or permanent IJLSIG URL; and
  4. the applicable CC BY 4.0 licence notice.

Where a preprint or accepted manuscript has been deposited before publication, the author should update its record with the citation and DOI of the final published article.

8. Preprints

Posting a manuscript as a preprint does not automatically constitute prior publication and does not, by itself, prevent submission to IJLSIG.

Authors must:

  1. disclose the existence and location of the preprint during submission;
  2. ensure that the preprint record is updated after publication;
  3. provide a link from the preprint to the final Version of Record; and
  4. disclose any substantial differences between the preprint and the submitted manuscript where relevant.

The manuscript submitted to IJLSIG must still satisfy the journal’s originality, ethics, and disclosure requirements.

9. Third-Party Materials

The CC BY 4.0 licence applies only to material for which the authors possess the necessary rights and which is not expressly excluded from the licence.

Third-party photographs, images, maps, tables, figures, instruments, documents, or other materials may be subject to separate copyright terms. Where third-party material is not covered by CC BY 4.0, the article must clearly state the applicable credit line or restriction.

Authors are responsible for:

  1. identifying third-party materials;
  2. obtaining any permission required for publication and open-access distribution;
  3. paying any permission fees, where applicable;
  4. retaining documentary evidence of permission; and
  5. providing accurate credit information.

Users who wish to reuse excluded third-party material must obtain permission directly from the relevant copyright holder unless an exception or limitation under applicable law applies.

10. Research Data, Software, and Supplementary Materials

Research data, software, instruments, and supplementary materials published with an article should be made openly available where legally, ethically, and practically possible. The licence applicable to supplementary materials must be clearly stated.

Authors must not make material openly available where doing so would violate:

  1. personal data protection;
  2. confidentiality;
  3. informed consent;
  4. professional secrecy;
  5. legal privilege;
  6. intellectual property rights;
  7. national security or public safety requirements; or
  8. another applicable legal or ethical obligation.

Where access is restricted, the authors should explain the reason and describe the conditions under which access may be requested.

11. Text and Data Mining

IJLSIG permits lawful text and data mining of openly accessible journal content in accordance with CC BY 4.0.

Users may download, analyse, index, or process journal content through automated means, provided that they:

  1. comply with the licence terms;
  2. provide appropriate attribution where required;
  3. do not misrepresent the content;
  4. do not interfere with the security or operation of the journal platform; and
  5. comply with applicable law.

12. Indexing and Metadata Harvesting

IJLSIG permits search engines, libraries, repositories, indexing services, and scholarly databases to:

  1. harvest publicly available metadata;
  2. index abstracts and full-text content;
  3. link to published articles;
  4. preserve bibliographic records; and
  5. provide discovery services.

Metadata should identify the article’s authors, title, journal, publication date, DOI, licence, and publication status. The journal may use the Open Archives Initiative Protocol for Metadata Harvesting (OAI-PMH) and other interoperable standards supported by its publishing platform.

13. Reader Charges

IJLSIG does not charge readers or libraries for:

  1. accessing an abstract;
  2. reading an article;
  3. downloading a published article;
  4. accessing a correction, expression of concern, or retraction notice; or
  5. using publicly available article metadata.

Any Article Processing Charge imposed on authors is separate from reader access and will be disclosed transparently under the IJLSIG Article Processing Charge Policy. Payment or non-payment of an Article Processing Charge must not determine the outcome of peer review or the editorial decision.

14. Permanent Access and Preservation

IJLSIG is committed to maintaining permanent access to its published content.

Published articles and metadata will be preserved through the journal’s own system and other preservation arrangements described in the IJLSIG Archiving Policy.

Where the journal ceases publication, reasonable efforts will be made to ensure that its published content remains available through recognised archives, repositories, or preservation networks.

15. Corrections and Retractions

Corrections, addenda, expressions of concern, retraction notices, and removal notices will remain openly accessible.

A retracted article will ordinarily remain available as part of the scholarly record but will be clearly marked as retracted and linked to the retraction notice.

Open access does not prevent IJLSIG from correcting, retracting, or removing content in accordance with its Retraction and Correction Policy.

16. No Additional Restrictions

IJLSIG will not impose digital rights management or other technological restrictions that unreasonably prevent users from exercising the rights granted under CC BY 4.0.

Users must not apply legal or technological restrictions that prevent others from exercising the rights granted by the licence.

17. Policy Changes

Any future change to the journal’s open-access or licensing policy will be stated transparently on the IJLSIG website.

A policy change will not retroactively restrict rights already granted under the licence attached to a published article.

The licence identified on each article constitutes the authoritative licence applicable to that article.
